There are several possibilities here;

1) that YOU have a koi that is a carrier and that is the cause of KHV. I have seen this happen many times before and the poor dealer get's the blame.

2) that the test is a false positive, It happens a lot.

3) that the dealer knows and is a sleeze ball

4) that the dealer is convinced he is not the source as he is ignorant ( not an insult but a state of education) to the idea that you can have it and your fish are not dying. I kinda suspect this as 'fish pooping' in a pond, does not an infection make! That parts kinda whacky. The dealer could also have carriers that are healthy but ticking time bombs and he is unaware of that.

So I would say no one knows for sure if it is truly KHV and who is at fault. Honestly I don't think there is any 'fault' here as much as there is bad luck and an unfortunate roll of the roulette wheel.
I'd suggest that a third party get involved and send two fish from your collection and from his stock to two different labs. You might find that one comes back positive and one negative so be prepared for that.
You two need to work together to solve this one. And it sounds like you are both past the point of communicating. This is why a third party might be helpful. Contact a thrid party within AKCA or ZNA and see if they will help.
I would caution you against naming names at this point as you can't say 100% that the dealer has KHV, although I'm sure the test results have you thinking with confidence that he does.

One of things I'd like to see the AKCA KHV program do is work with 4 labs around the country and have all samples sent to those four labs. In return for the referrals, I would like these labs to keep records of samples. This data bank will become invaluable as it accrues data over time. In this case it would be helpful in that if other customers of the dealer come in positive we can contact the dealer and give him or her a heads up and encourage them to stop selling that lot. - JR
