Everyone should understand that a patent can be obtained without demonstrating that the invention works well in practical application. Just because there is a patent does not mean that this is something anyone should want to imitate. And, of course, the fact that there is a patent means that nobody can copy it without permission of the patent holder.
In my personal opinion, I hope all obey the law assiduously, because I do not think this will work for koi hobbyists without also utilizing maintenance techniques not revealed in the patent. And, remember, in Japan it is common for there to be a constant in-flow of fresh water at a rate of 10% or more per day.
I am sure Sakai has succeeded in using this method, because he is an honorable man who would not associate his name with anything in which he did not believe. That does not mean, however, that anyone else would succeed. Unless you know everything that is being done to successfully operate such a pond, you cannot know if you are doing what Sakai does.
I hope all the lurkers take this to heart. Just as rock-bottomed Aquascape ponds are touted as wonderful and virtually maintenance-free, and nearly always result in sick and dying koi, a sand-bottom pond is going to be a disaster for 99% of those who try to imitate this concept. Don't infringe the patent. It is against the law. And, this time around, the law is saving you from yourself! |
