They are protected by the Migratory Bird Treaty Act in all of North America. Besides that, they have mystical powers.

They may be protected against the Bird treaty, but they are not protected against a 9mil.. Years ago we lost some in our small 2000 gallon pond, but after one of them and me had a one on one discussion, we never had a problem again, I don't think they like the Female Rambo...

Dude better off putting lattice over it with a 2x2 frame. It's like jail for the koi but safe? Or maybe a low overhang to keep them out of sight? How deep is your pond UC? Or maybe I'll send you a picture of me poster size to scare the damn thing out of it's mind.

Motion activated sprinkler did not work for me... It scared them for first few times, but seems like they finally figured it out and came back as normal...
I used fishing line and seems like it works for me.

cocoboy + nancy,

sight seeing also worked for me (either with a 9m or a high power air
rifle)

I just want to see their pretty color feather. That's all.

And Dinh,

There are a lot of protected things in CA including tree rats, but when people pay $$$$ for a koi to which they are attached to, they are prepared to go pretty far to stop these birds from hurting/taking their fish. I am one of those people

Being unkind to our feathered friends could give koi keeping a bad name. You will not get much sympathy from your nosey neighbors or the judge.

My pond is 6 1/2 feet deep, 1 1/2 feet of it is raised so the kids dont go swimming. I cannot wait for the pond to be redone. I am not sure if fishing line would work as I have seen herons walk on the grass from one side of our fence to the other.

that means your neighbors already hate you even before you do anything
if they don't, you won't have any problem.
My neighbor even offers to do the "sight seeing" for me while I am not home . That's why we call it "neighborhood". Got to build up your hood, bekko! then u don't have to worry.
