I have often been charged sales tax for fish as well as pond supplies purchased out of state. When brought to their attention, they apologized, made a credit and said that the accounting software that created the invoice adds tax automatically and sometimes they forget to go in and manually delete it. (More likely they are all using QuickBooks and just don't know how to set the filters to delete sales tax on out of state addresses.)

I do like the idea of claiming no sales tax for 'food' items. Koi-Kebobs. MMM. Thems good eats.

California dealers, have to charge sales tax. I know at Eastern there are several signs that say "sales tax included in fish price". Uncle Sam, wants his cut, it would be kind of hard to say you eat those babies, when you sell all the other stuff to build a koi pond.

Fortunately there is no national sales tax in the USA, only state sales taxes. No CA seller (fish related or otherwise) has ever charged me sales tax on items shipped to states where they do not have a bricks-n-mortar physical presence.

But yeah, for sales within your own state I think it would be hard to say koi are a food item when you sell pond supplies too -- maybe they need to sell Old Bay seasoning as well.
