Sales tax on koi ?

Friend and I got talking and ended up looking through our receipts out of curiousity. Between us, in the last 4 years, we've purchased koi from eleven different dealers in the state of California. Eight of those eleven did not charge sales tax. Three did. Can anyone explain what the difference might be?

I have dealt with most of the koi dealers in California and I have to say cash is mightier than credit card.

if you live outside of CA and your purchases were delivered to outside CA addresses, the dealer should not collect sale tax. if they collected sale tax, ask them for a refund.

I have only paid sales tax from 2 dealers/ 1 of them charged me tax a few times and didn't another time...

CASH does work better for everyone

Some dealers include it in their price of the Koi and others don't. By law any purchase has to be charged with sales tax. Unless it is an out of state sale. Cash is King though.

In Texas, "Farm products" sold direct from the farm to the consumer are not taxable.

If you buy a koi at a koi shop, it is taxed. At a koi farm or from the koi farmer at a show, not taxed.

Of course, what's been said about cash...

If the fish is sold as an ornimental "pet" AND the dealer is selling to anyone in a state where he/she holds a sales tax number, then tax should be collected. It is my understanding (In Minnesota) if you do not pay sales tax through your dealer because your dealer does not hold a sales tax number in Minnesota, then I'm liable for paying "use tax" on that purchase. But like was said above, if you're gonna eat 'em, then it is consider food fish, not taxable. But please check your individual states laws. Each state may have a different set of rules for "state sales tax".

The dealer looked at you and made up a price for the fish. On a given day, it probably could have been 25% more or 25% less. Does it matter if they add on sales tax? Maybe the dealer adds sales tax when he realizes he could have made the sale at a higher asking price.
